Terms of Service for LexiMory

Agreement to Terms

These Terms of Service ("Terms") are a legal agreement between you and LexiMory ("we," "us," or "our") governing your use of the LexiMory mobile application (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

The Service

LexiMory is a vocabulary learning app that helps you build and review vocabulary using spaced repetition, images, audio, and example sentences. The App is free to use, with an optional Pro subscription described below.

Free Tier and Daily Word Limit

• Free users may add up to 10 new words per day (local timezone), counted across all categories. This limit resets at local midnight
• Reviewing words you have already added is always unlimited, for both free and Pro users
• Once the daily limit is reached, you can either wait until the next day or upgrade to Pro to remove the limit

Pro Subscription

LexiMory offers an optional auto-renewing "Pro" subscription that removes ads and lifts the daily new-word limit. The following terms apply to the subscription:

• Plans: Monthly, 3-month, and Annual billing options are offered, each shown with localized, store-formatted pricing at the time of purchase
• Free Trial: New subscribers may be eligible for a 5-day free trial. If you do not cancel before the trial ends, you will be charged for the selected plan
• Billing and Renewal: Payment is charged to your Apple ID or Google Play account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Managing and Canceling: You can manage or cancel your subscription at any time in your Apple ID or Google Play account settings. Uninstalling the App does not cancel your subscription
• Refunds: Refund requests are handled by Apple or Google according to their respective policies; we do not process payments or refunds directly
• Restore Purchases: If you reinstall the App or switch devices, use the "Restore Purchases" option to reinstate an active subscription
• Price Changes: We may change subscription prices from time to time; where required, we will notify you in advance and any change will apply only to future billing periods

Advertisements

Free-tier users may see occasional full-screen ads served through Google AdMob, shown at natural breaks in the review flow. Pro subscribers do not see ads. See our Privacy Policy for details on how ads are served.

Acceptable Use

When using LexiMory, you agree not to:

• Use the App for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to reverse engineer, decompile, or extract the App's source code, except as permitted by law
• Interfere with, disrupt, or attempt to circumvent the App's subscription, ad, or usage-limit mechanisms
• Use automated means (bots, scrapers) to access or interact with the App in a way not intended for ordinary use

Your Content and Data

Vocabulary lists, categories, and progress you create in the App are stored locally on your device, as described in our Privacy Policy. You are responsible for backing up your device if you wish to preserve this data — uninstalling the App or clearing its storage permanently deletes it.

Intellectual Property

The App, including its design, code, and bundled dictionary and example-sentence databases (excluding third-party open-source content credited in our Privacy Policy), is owned by LexiMory and protected by copyright and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the App on your personal devices for its intended purpose.

Third-Party Services

The App relies on third-party services — including Microsoft Translator, Google Firebase, Google AdMob, and RevenueCat — to provide certain features. Your use of features backed by these services is also subject to the respective third party's own terms, in addition to these Terms.

Disclaimer of Warranties

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that translations, ad delivery, or subscription processing will always function without issue.

Limitation of Liability

To the maximum extent permitted by law, LexiMory shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data (including vocabulary or learning progress stored locally on your device), arising from or related to your use of the App.

Termination

You may stop using the App at any time by uninstalling it. We may suspend or discontinue the App, or any feature of it, at our discretion, though we will try to give reasonable notice of material discontinuations. Terminating use does not entitle you to a refund of any subscription fees already paid, except as required by Apple's or Google's policies.

Changes to These Terms

We may update these Terms from time to time to reflect changes in the App or legal requirements. We will notify you of significant changes by:

• Updating the "Last Updated" date at the top of these Terms
• Displaying an in-app notification for material changes
• Including update notes in the app store listing

Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

Governing Law

These Terms are governed by applicable law without regard to conflict-of-law principles, and without prejudice to any mandatory consumer-protection rights you may have under the law of your country of residence.
